Under the provisions of the Bersani Law of 2007, financial institutions must inform the land registry office of mortgage cancellation, not only relating to new mortgage loans, but also concerning previously registered mortgages which have not yet been canceled and where the debtor has requested release from their obligations. |
Mortgage management is a rather complex process and starts when the financial institution sends CRIF the details relating to a mortgage file. CRIF then starts a search for the mortgage registration notes to be canceled or renewed at the appropriate land registry office, with the aim of verifying the consistency, accuracy and unambiguity of the notes. In the case where more than one note is present for more than one property for the same subject, CRIF will contact the financial institution in order to obtain any other relevant information and to unequivocally trace the correct mortgage.
Once the information has been collected and the input data supplied by the institution, CRIF puts the cancellation or renewal request in electronic format, based on the standard forms of the land registry.
